California low carbon fuel standard (LCFS) blocked by court

3 January 2012

A judge at the US District Court in Fresno issued a preliminary injunction on the enforcement of California low carbon fuel standard (LCFS). The LCFS rule was determined to violate the Commerce Clause of the US Constitution by attempting to regulate commercial activities that take place in other states, such as corn farming, ethanol production or refiner?s use of coal-based electricity.

The LCFS was challenged in court by two groups: a coalition of corn growers led by Rocky Mountains Farmers Union and by fuel refiners led by the National Petrochemical and Refiners Association.

The LCFS was approved in 2009 and became fully effective in April 2010. The standard?one of the key components of California GHG emission reduction plan?has been designed to reduce the carbon intensity of transportation fuels used in California by 10% by 2020. Under the law, fuel manufacturers and importers must ensure that their overall fuel mix sold in California meets the carbon intensity targets set by the standard.

The LCFS carbon intensity is based on life cycle analysis, including the so called ?indirect land use changes? (ILUC)?the release of GHG emissions resulting from convening land from other uses to growing biofuel feedstocks (such as ethanol or soybeans). Under the LCFS, ILUC effects increase the carbon intensity of ethanol by as much as 30%, making its life cycle carbon score comparable or higher than that of gasoline and putting ethanol at a disadvantage. In addition, the LCFS carbon intensity ratings?which depend on production methods and the carbon intensity of energy used in the production process?have penalized corn ethanol produced in some other states, for instance in Nevada, compared to ethanol produced in California. The Court found this to be in violation of the constitutional Commerce Clause which grants Congress the authority to regulate commerce among the states and limits the power of the states to discriminate against or unduly burden interstate commerce.

To comply with the injunction, the California Air Resources Board (ARB) issued a regulatory advisory suspending LCFS requirements for 2011 and 2012. The ARB also said it intends to appeal the court rulings.

Fish and chip fever batters South Africa

There may be something very British about the local chippie, but that doesn't mean it can't be successful overseas.

Fish and chip shops are spreading fast in South Africa and visibly booming. The Old Fashioned Fish and Chips chain, which claims to have got in first, doubled its reach last year and plans to keep expanding.

Others are joining the craze and hoping to trade on Britain's global reputation for crispy batter and golden chips.

Shop signs for the Fish and Chip Company carry the slogan "Traditional English-style food" and a logo of a fish wearing a top hat and waving a union flag.

The meals, costing ?2-?3, are up against South Africans' usual favourites ? biltong, bobotie, boerewors (spicy sausage), bunny chow, mopane worms and pap (porridge made from maize meal).

Fish and chips are not new here, said Nicolas de Sousa, operations and marketing director of Old Fashioned Fish and Chips. Cape Town has more of a tradition, but in Johannesburg as elsewhere in the republic, the food would typically be sold from corner cafes along with other foods.

I

"South Africa doesn't have a direct tradition of fish and chips like Britain," said De Sousa, 29. "It had the corner street cafe that sold everything, including fish and chips. It wasn't a core product.."

He and his mother created a franchise in 2005 and the business grew rapidly, to 300 outlets with revenues of 250m rand (?20m).

Initially De Sousa believed the product would appeal to lower-income groups but admitted he was surprised by the popularity of fish and chips across the social spectrum. "As time has gone on, the target market has increased," he said.

South Africa already has the London Pie Co, complete with pictures of Big Ben, but De Sousa denied being influenced by the classic British chippie. "The product was South African-based. A lot of British shops start with cod but we stuck with hake. South Africans like soft chips."

In what might appear a case of coals to Newcastle, Old Fashioned Fish and Chips is hoping to open shops in Britain by 2014.

"I lived in Britain for six or seven years and was always a fan of fish and chips. But I think they lack creativity," De Sousa said.

"Harry Ramsden's could do it differently. Playing the batter is part of our success. If we take it to Britain, I think we'll have success based on that."

South Africa is the third fattest nation in the world, according to a recent survey, but De Sousa does not believe he is contributing to the obesity epidemic.

"The main thing is it's organic. We use fresh hake, sausages and potatoes. Although it's deep fried, the appeal to the health conscious has a massive role to play. There isn't one product that isn't organic."

On a recent afternoon there was high demand at the Old Fashioned Fish and Chips shop in the Campus Square mall in Johannesburg. Big portions with fat chips and lashings of salt and vinegar were wrapped in white paper and handed to hungry customers, who sat and consumed them on rudimentary blue-painted benches.

Customer Busi Makhubo, 21, said: "It's very convenient and affordable. There are a lot of chips compared to other places.

"I've never been to Britain and don't know what they eat there. These fish and chips are like in the township. In Soweto these shops are packed with black people."

Her mother, Phindi, 50, was less impressed: "They should put it on a plate. People are eating like dogs on a street. And all the sauces are wrong."

Marlins' Ramirez says he'll accept switch to 3B (AP)

SANTO DOMINGO, Dominican Republic ? Hanley Ramirez says he'll accept a position switch to third base so Miami Marlins newcomer Jose Reyes can play shortstop.

When Reyes signed a $106 million, six-year deal with Miami last month, there was speculation Ramirez was unhappy about being supplanted at short. But new manager Ozzie Guillen sold Ramirez on the idea.

"I have spoken with Guillen," Ramirez said. "What we want is to win with the Marlins. We will see what's going to happen with the position switch and everything else. If it's third base, OK. Wherever they put me to win, I will do so."

With Reyes at shortstop and Ramirez at third, the Marlins become stronger defensively at both positions, and more potent offensively. Reyes hit .337 with the New York Mets last year to win the NL batting title, and Ramirez ? a career .306 hitter ? was the 2009 batting champ.

The two Dominicans are friendly, although Reyes recently said he hadn't heard from his fellow All-Star since signing.

"Between Reyes and me there is no problem," Ramirez said. "I respect him very much. He is a great person."

Ramirez spoke while taking batting practice at a Santo Domingo stadium Friday. He missed the final two months of last season with a left shoulder injury that required surgery.

"The shoulder is responding, and it's 95 percent rehabbed," Ramirez said. "I'm happy and better than ever."

He said he's excited about the Marlins' offseason spending spree, which included the signings of Reyes, left-hander Mark Buehrle and All-Star closer Heath Bell, each an All-Star.

"We are a new Marlins club," Ramirez said. "There's also a new Hanley. Good stuff is coming for next season."

India see red over green Sydney track

Zaheer Khan getting better with every outing and young Umesh Yadav firing them in all the time, Australian batsmen will not have it easy either. (AFP Photo)

SYDNEY: A definite tinge of green on the SCG track was not really surprising, but the Indian team was tight-lipped about the 22-yard surface that holds the key to the second Test and the series against Australia.

At the MCG, quite a bit of thick dead grass had been rolled into the surface by the curator. It explained the spongy bounce. But with a fair bit of live grass, the SCG pitch looks firm and nice. According to curator Tom Parker, it will yield some turn on the last two days.

The Indians, however, are not taking Parker's word on face value. They are not quite worried about the grass, but the firmness of the wicket is making them see red. The three-pronged Australian pace attack - comprising Ben Hilfenhaus, James Pattinson and Peter Siddle - didn't go flat out in the nets, but had one eye on the square during a game of touch rugby inside the main arena. "The Sydney pitch is no longer as pace-friendly as it used to be a few seasons ago, but it should still keep our bowlers interested," said Mike Hussey.

Siddle, Hilfenhaus and Pattinson would be looking to give Indian batsmen a repeat dose of raw pace and steep bounce that they had served with relentless consistency at the MCG.

There was hint of a smile on Ishant Sharma and Zaheer Khan's faces. It was at this venue that Ishant had come of age four years ago and almost turned Ricky Ponting into his 'bunnyr'. The lanky pacer from Delhi will be itching to go all out here. And with Zaheer getting better with every outing and young Umesh Yadav firing them in all the time, Australian batsmen will not have it easy either.

India's batting continues to be a worry. The top guns, as well as the young turks, had a good session in the nets, but the body language continued to be sloth even as selectors Mohinder Amarnath and Narendra Hirwani tried their best to pep up the mood in the camp.

While the out-of-form Gambhir asked Amarnath to watch him bat in the nets and check if he was doing anything wrong, Hirwani was seen giving R Ashwin a few tips on releasing the ball as Ojha toiled hard under the sun, trying hard to make an impression. Given the nature of the wicket, though, it is unlikely that India will go in with two spinners here.

Both Australia and India are likely to retain the XI that did duty at the MCG.
